How it works

Decision boundaries

The decision framework for orphan works use requires distinguishing three operational categories:

Category A — Confirmed public domain. Works published before January 1, 1928, are in the public domain under U.S. law as of 2024 (17 U.S.C. § 302). Works published between 1928 and 1977 require date- and registration-specific analysis using the Copyright Office's registration and renewal records.
